Privacy policy

www.bayernkapital.de is an offer of Bayern Kapital GmbH. Bayern Kapital appreciates your visit to our website and your interest in our company and our services. The protection of your personal data during the collection, processing and use on the occasion of your visit to our homepage is an important concern for us.

We do not assume any liability for external links to third-party content, despite careful control of the content, as we have not initiated the transmission of this information, have not selected the addressee of the transmitted information and have not selected or changed the transmitted information.

The collection, processing and use of your data takes place within the framework of the legal regulations, about which you can obtain comprehensive information, e.g. under www.datenschutz.de. In the following, we explain what information we collect during your visit to our websites and how it is used:

Collection and processing of data, possibly personal data

Every time a user accesses a Bayern Kapital page and every time a file is retrieved, data about this process is stored in a log file. The data is stored exclusively for internal system-related and statistical purposes. Specifically, the following data record is stored for each retrieval:

  • Name of the retrieved file
  • Date and time of retrieval
  • Amount of data transferred
  • Message as to whether the retrieval was successful
  • Description of the type of web browser used
  • Requesting domain.

Additional personal data such as your name, address, telephone number or e-mail address will not be collected, unless you provide this information voluntarily, e.g. in the context of a registration request, a survey, a competition, the execution of a contract or a request for information.

Use and transfer of personal data

Insofar as you have provided us with personal data, we will use it exclusively for the purpose of the technical administration of our websites and to fulfil your wishes and requirements, in particular to process the contract concluded with you or to answer your enquiry. The data will be stored for as long as is necessary to achieve the purpose.

Your personal data will not be passed on, sold or otherwise transferred to third parties, unless

  • this is necessary for the purpose of executing the contract. For example, when ordering products, it may be necessary for us to pass on your address and order details to our suppliers.
  • this is necessary for billing purposes.
  • you have previously consented.

You have the right to revoke such consent at any time with effect for the future, Art. 7 (3) GDPR. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal.

The deletion of the personal data takes place,

  • if you withdraw your consent to the storage.
  • If your taking note is no longer required to fulfil the purpose pursued by the storage or if its storage is inadmissible for other legal reasons.

Use of video conferencing services

Type and scope of data processing
If, at the invitation of Bayern Kapital, you use a video conferencing service provided for the conduct of video conferences, online meetings and webinars, the following data is processed:

  • Registration information (email address, activation codes, conference codes, user name, password, first name, last name, company name, organisation ID)
  • Configuration and communication data (device name, geospatial data, IP address, time zone, domain name, activity logs, hardware type)
  • Conference information (title, date, time, duration, number of meetings, number of participants, host name, screen resolution, dial-in method)
  • Support services (name, email address, phone number, authentication information, system information).

Purpose of processing and legal basis
The processing of the above-mentioned personal data is used to set up and conduct online meetings and video conferences.

Insofar as the processing of personal data is necessary for the performance of a contract to which you are a party or is necessary for the implementation of pre-contractual measures taken at your request, Art. 6 (1) (b) GDPR serves as the legal basis for the processing of personal data.

Insofar as the processing of personal data is necessary for the fulfilment of a legal obligation to which Bayern Kapital is subject, Art. 6 (1) (c) GDPR serves as the legal basis.

If there is no contractual relationship, the legal basis is Art. 6 (1) (f) GDPR. Bayern Kapital has a legitimate interest in the effective conduct of online meetings and video conferences.

Mailchimp

This website uses the services of MailChimp to send newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. MailChimp is a service that, among other things, can be used to organise and analyse the sending of newsletters. If you enter data for the purpose of subscribing to the newsletter (e.g. e-mail address), it will be stored on MailChimp's servers in the USA.

With the help of MailChimp, we can analyse our newsletter campaigns. When you open an e-mail sent with MailChimp, a file contained in the e-mail (so-called web beacon) connects to MailChimp's servers in the USA. In this way, it can be determined whether a newsletter message has been opened and, if so, which links have been clicked. In addition, technical information is collected (e.g. time of access, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. They are used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients.

If you do not want to be analysed by MailChimp, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. Data processing is carried out on the basis of your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The lawfulness of the data processing operations that have already taken place remains unaffected by the revocation. The data you provided us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after unsubscribing from the newsletter. Data that has been stored by us for other purposes remains unaffected by this.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: mailchimp.com/eu-us-data-transfer-statement/ and https://mailchimp.com/legal/data-processing-addendum/#Annex_C_-_Standard_Contractual_Clauses.

After you have unsubscribed from the newsletter distribution list, your e-mail address may be stored in a blacklist by us or by the newsletter service provider in order to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interests and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) (f) GDPR). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest. For more information, please refer to MailChimp's privacy policy at: https://mailchimp.com/legal/terms/.

  • the right to object in accordance with Article 21 GDPR
  • the right to lodge a complaint with the competent supervisory authority, Art. 77 GDPR.
